Adoption and alternative child care in the Philippines were simplified by RA 1164, Domestic Administrative Adoption and Alternative Child Care Act.1 Today, many cases no longer go to court, the process is handled by a national agency to make it faster, cheaper, and more child-friendly.
What Counts as “Alternative Child Care”?
Under RA 11642,2 “alternative child care” includes several options when a child cannot safely stay with their biological parents:
- Domestic Administrative Adoption – Filipino families adopt a child through National Authority for Child Care (NACC), not the courts.
- Inter-Country Adoption – Adoption by qualified foreign residents, still supervised by the NACC.
- Foster Care (including Kinship/Relative Foster Care) – Licensed families, including relatives up to the 4th degree, temporarily care for a child.
- Residential/Institutional Care – Short-term placement in licensed child-caring agencies when a family setting isn’t yet available.
Who May Adopt?
Basic qualifications (simplified):
- At least 25 years old and at least 16 years older than the child (with some exceptions, like adopting your spouse’s child).
- Of good moral character, emotionally and psychologically capable to care for a child.
- Able to support the child.
The NACC provides detailed guidance and screens applicants thoroughly.
The Administrative Adoption Flow (Simple Version)
- Inquiry & Orientation – Prospective parents contact NACC or local social welfare offices to learn the process.
- Home Study – A licensed social worker reviews your family’s readiness (interviews, home visits, documents).
- Matching – If cleared, NACC matches a child who is legally available for adoption.
- Supervised Trial Custody (STC) – The child stays with the family for a trial period under social worker supervision.
- NACC Order of Adoption – If STC goes well, NACC issues the Order of Adoption (this is now the legal basis, replacing a court decree for domestic cases).
- Civil Registry – The child’s birth record is updated to reflect the new legal parent-child relationship.
